Shipping policy
1 TERMS AND CONDITIONS
The order can only be dispatched once payment of the full price and transport costs has been received in accordance with the stipulations of article 8.3.
Any event of force majeure, which would tend to prevent or render exorbitant the execution of supplies, constitutes, by express agreement, a cause for suspension or extinction of ARAKU's obligations, without compensation to the Client, in accordance with the stipulations of article 16. Thus, and if the event of force majeure should continue beyond a period of fifteen (15) days, ARAKU will inform the Client by any appropriate means in order to agree, if necessary, on an alternative solution and, failing that, to allow either of the parties to terminate the contract by sending a simple letter or e-mail.
2 DELIVERY COSTS
The delivery charges for orders placed on the site are as follows:
- Point Relais: €3 for orders under €50, free for orders over €40.
- Home delivery: €5 for orders under €50, free for orders over €60.
Delivery costs are communicated before the sale is concluded and then confirmed when ARAKU sends the e-mail asking the Customer to validate the order.
3 DELIVERY TIMES
Metropolitan France
The usual delivery times, excluding holiday periods (Christmas, New Year's Day, Easter) are three working days (i.e. excluding Saturdays, Sundays and public holidays) from the day following receipt by ARAKU of the order and payment. During public holidays, the usual delivery times are a minimum of five working days from the day following receipt of the customer's order and full payment.
In any event, except in cases of force majeure, ARAKU undertakes to deliver the products at the latest within thirty (30) days of sending its order confirmation, subject to payment of the order by the Customer (hereinafter "the Delivery Deadline").
4 LATE DELIVERY
If the Delivery Deadline is exceeded for reasons other than force majeure or non-payment by the Client, the latter may terminate the contract either by registered letter with acknowledgement of receipt sent to ARAKU (Customer Service - 14, Rue de Bretagne - 75003 Paris), or by writing on any other durable medium (e-mail, fax) if, after having enjoined ARAKU, by the same means (registered letter or writing on any other durable medium), to make the delivery within a reasonable additional period, the latter has not complied within this period.
The contract shall be deemed to have been terminated on the date of receipt by ARAKU of the letter or writing informing it of such termination, unless ARAKU has performed in the meantime. ARAKU then undertakes to reimburse the Customer the sums paid by the latter, within a maximum period of fourteen (14) days following receipt of the letter of cancellation, by bank transfer or cheque.
Consequently, any delivery made after the Delivery Deadline but before the receipt by ARAKU of the Client's letter of cancellation shall in no way justify the cancellation of the order, nor give rise to damages, indemnities or penalties. Nevertheless, the Client may immediately terminate the contract if ARAKU does not fulfil its obligation to deliver the product(s) on the date or at the end of the period stipulated and this date or period constitutes for the Client an essential condition of the contract, said essential condition resulting from the circumstances surrounding the conclusion of the contract or from an express request by the Client prior to the conclusion of the contract.
